These Terms of Service ("Terms") govern your access to and use of the Rahaal website, mobile applications, and related services (collectively, the "Platform"), operated by MARISYS TECH TECHNOLOGY - L.L.C, a company incorporated under the laws of United Arab Emirates ("we," "our," or "us").

By accessing or using the Platform, you agree to these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Platform.

1. Eligibility

• You must be 18 years or older to create an account.
• Users aged 16–17 may register with verified parental/guardian consent, unless prohibited by local law.
• You may not use the Platform if you are prohibited by applicable law from receiving our services or have been previously suspended.
• We reserve the right to verify your identity and eligibility at any time.
• Minor users (16-17) must provide verifiable parental consent through our designated mechanism before account activation.

2. User Representations

By using the Platform, you represent and warrant that:

• All information you provide is accurate, current, and complete.
• Your use of the Platform complies with all applicable laws and regulations.
• You have the right to provide all information and content you submit.
• All information provided for government verification purposes is true and lawful.
• You will update your information promptly if any changes occur.

3. Account Registration & Security

• You must provide accurate, current, and complete information during registration.
• You are responsible for all activities under your account.
• You must maintain the confidentiality of your password and notify us immediately of unauthorized use.
• Inactive accounts (no login activity for 24 months) may be archived or deleted after notice.

4. Acceptable Use & Prohibited Conduct

You agree not to:

• Post unlawful, misleading, defamatory, obscene, or harmful content.
• Engage in harassment, hate speech, or discrimination.
• Upload viruses, malware, or any harmful code.
• Spam, solicit, or otherwise misuse the Platform.

We reserve the right to remove content, suspend, or terminate accounts for violations.

5. Content Ownership & License

• Your Content – You retain ownership of all content you post.
• License to Us – By posting content, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free license (with the right to sublicense) to use, host, store, reproduce, modify, adapt, publish, create derivative works from, distribute, and publicly display such content in any media for operating and improving the Platform, AI model training, market research, and syndication to partners.
• You waive all moral rights in your content to the maximum extent permitted by law.

6. Public Content Notice

• Any content you post or share on the Platform that is publicly accessible may be viewed, copied, or used by other users and third parties.
• You are responsible for the information you choose to make public, including profile information, resumes, and job postings.
• We are not responsible for how other users or third parties use your publicly shared content.
• Consider your privacy settings carefully and review what information is visible to others before publishing.

7. AI-Generated Content

• We provide AI tools for generating resumes, job postings, and professional summaries.
• AI outputs are provided "as is" and may contain errors.
• You are solely responsible for reviewing and ensuring accuracy before use.
• AI-generated content must not be solely relied upon for legal, hiring, or visa purposes without independent verification.
• We are not liable for any legal or employment consequences arising from unverified AI-generated data.
• Liability for AI-generated content is capped at AED 50, separate from general liability limits.

8. Paid Services & Billing

• Paid services (e.g., premium listings, AI credits) are billed according to our pricing at purchase.
• All fees are in AED and subject to applicable taxes.
• Payments are non-refundable unless required by law or stated otherwise.
• We may suspend or terminate services for non-payment.

9. Privacy & Data Use

Your use of the Platform is subject to our Privacy Policy. By using the Platform, you consent to the collection, processing, storage, and sharing of your data as described in the Privacy Policy, including use of your data (including anonymized or aggregated data) for AI training, analytics, and business partnerships.

10. Third-Party Content & Services

• The Platform may display job listings, ads, or links from third parties.
• We do not endorse or guarantee third-party content and are not responsible for it.
• Interactions with third parties are solely between you and them.
• Downtime, errors, or delays from third-party systems are outside our control.
• We do not guarantee continuous availability of government or partner integrations.

11. Employment & Job Listing Liability Waiver

• You do not guarantee job offers or employment.
• We are not responsible for employment terms, salary disputes, or contract enforcement between employers and job seekers.
• We are not responsible for the accuracy of employer or candidate claims.

12. Specific Government Integration Notice

• Users acknowledge that certain data may be shared automatically with relevant government entities for compliance, verification, or statistical purposes.
• Such sharing will be in accordance with applicable laws and agreements with said entities.

13. Data Processing Addendum (DPA)

• We act as a data controller for personal data processed through the Platform.
• We implement data minimization practices and secure transmission protocols.
• We will report data breaches within 72 hours to affected parties and relevant authorities as required by law.

14. Disclaimers

• Services are provided "as is" and "as available".
• We disclaim all warranties, including merchantability, fitness for purpose, and non-infringement.
• We do not guarantee uninterrupted or error-free service.

15. Limitation of Liability

To the fullest extent permitted by law:

• We are not liable for indirect, incidental, consequential, or punitive damages.
• Our total liability for any claim will not exceed the greater of AED 100 or the amount paid by you in the past 12 months.
• Liability for AI-generated content is separately capped at AED 50.

16. Indemnification

You agree to indemnify and hold us harmless from claims, damages, or losses arising from your use of the Platform, your content, or your breach of these Terms.

17. Governing Law & Dispute Resolution

• Governing law: UAE law.
• Disputes shall be resolved first by good-faith negotiation, then by binding arbitration under Dubai International Arbitration Centre (DIAC) Rules.
• Venue: Abu Dhabi, UAE.
• Each party bears its own costs unless the arbitrator orders otherwise.
• In the event of a conflict between the English version of these Terms and any translated version, the English version will prevail.

18. Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including but not limited to: acts of God, war, terrorism, riots, government restrictions, pandemics, cyberattacks, or failures of third-party systems including government APIs.

19. Changes to Terms

We may update these Terms from time to time. Updates will be posted on the Platform and notified to you. Continued use means acceptance.
